1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of midwesthomesandrestoration.com (the “Website”) and all services provided by Midwest Homes & Restoration (“we,” “us,” or “our”). By accessing the Website or engaging us for services, you agree to these Terms. If you do not agree, do not use the Website.

We are a licensed roofing, siding, and gutter contractor serving Northwest Missouri, Northeast Kansas, Southeast Nebraska, and Southwest Iowa. We are licensed and registered in Missouri, Kansas, Iowa, and Nebraska, and hold business licenses in Kansas City, MO; St. Joseph, MO; Omaha, NE; and Falls City, NE.

3. Use of the Website

You may use the Website for lawful purposes only. You agree not to:

  • Use the Website to violate any law or regulation
  • Submit false or misleading information through forms
  • Attempt to gain unauthorized access to any part of the Website or our systems
  • Interfere with or disrupt the Website’s operation
  • Scrape, copy, or republish substantial portions of the content without written permission

We may suspend or terminate access to anyone who violates these Terms.

4. Estimates, Quotes, and Service Agreements

  • Free estimates provided on the Website or in person are good-faith estimates based on visible conditions and the information available at the time. They are not binding contracts.
  • Final pricing, scope, schedule, and warranty terms are governed by the written work agreement signed by both parties before work begins.
  • Material prices, scope changes, and unforeseen conditions discovered during work may affect final cost — we will communicate any change orders in writing for your approval.
  • We do not require deposits to begin work. Payment terms are stated in your signed agreement.

5. Insurance Claim Coordination

We help customers coordinate with insurance carriers on storm-damage claims. You should know:

  • We are a contractor, not a public adjuster, attorney, or insurance professional. We do not provide legal, tax, or insurance advice.
  • The decision to accept or deny any insurance claim is made by your insurance carrier, not by us.
  • We will not represent that any specific claim outcome is guaranteed.
  • You remain responsible for any deductible, depreciation, or other costs not covered by your insurance carrier.

6. Warranties

Workmanship Warranty

We warrant our workmanship for ten (10) years from the date of substantial completion, subject to the specific terms in your written work agreement. The warranty covers defects in our installation, not damage caused by acts of God, abnormal use, modifications by others, or normal wear and tear.

Manufacturer Warranties

Roofing, siding, and gutter products carry separate manufacturer warranties (e.g., limited lifetime shingle warranties). Manufacturer warranties are issued and administered by the manufacturer, not by us. We will provide warranty documentation at completion.

[REVIEW] EXCEPT FOR THE WORKMANSHIP WARRANTY EXPRESSLY STATED IN YOUR SIGNED WORK AGREEMENT, ALL SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES — EXPRESS, IMPLIED, OR STATUTORY — INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

[REVIEW] TO THE FULLEST EXTENT PERMITTED BY LAW, MIDWEST HOMES & RESTORATION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR OUR SERVICES, EVEN IF WE’VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE WEBSITE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

This limitation does not apply to liability for our gross negligence, willful misconduct, or any liability that cannot be limited by applicable law.

8. Intellectual Property

All content on the Website — text, photos, logos, designs, code — is owned by Midwest Homes & Restoration or our licensors, and is protected by copyright and trademark law. You may not reproduce, distribute, modify, or republish content without our prior written consent.

You may share links to our pages on social media or in personal communications.

9. User-Submitted Content

If you submit photos, descriptions, reviews, or other content to us (whether through forms, email, text, or other channels), you grant us a non-exclusive, royalty-free, worldwide license to use that content for our business purposes — including marketing materials, before-and-after galleries, case studies, and online reviews — unless you specifically tell us otherwise in writing.

You represent that you have the right to submit any content you provide and that it does not infringe anyone else’s rights.

10. Third-Party Services and Links

The Website may include links to or embeds from third-party services (Google Maps, Facebook, GoHighLevel, etc.). We are not responsible for the content, accuracy, or practices of those services.

11. Communications by Phone, Text, and Email

By providing your phone number or email, you consent to receive communications from us related to your inquiry, estimate, or project. For marketing communications, separate consent applies — see our SMS Terms and Privacy Policy for details.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles.

Any dispute arising out of or related to these Terms or your use of the Website will be resolved as follows:

  1. Informal resolution first. Contact us at dave.mwhr@gmail.com or (800) 544-8610 and we’ll work with you in good faith for at least 30 days to resolve the matter informally.
  2. Venue. If informal resolution fails, any legal action must be filed in the state or federal courts located in Buchanan County, Missouri. Each party consents to the personal jurisdiction of those courts.

[REVIEW — optional] Some businesses prefer mandatory arbitration and class-action waivers in this section. We have not included those by default; an attorney should advise based on your preference and applicable Missouri law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised “Last Updated” date. Continued use of the Website after changes constitutes acceptance.

14. Severability

If any part of these Terms is found unenforceable, the rest of the Terms remain in effect.
